In a decisive win for its client, Heritage Hard Assets LLC, Shaw Lewenz successfully secured the dismissal of a telemarketing lawsuit in the United States District Court for the Western District of Oklahoma. The complaint alleged violations of the Telephone Consumer Protection Act (TCPA) and Telemarketing Sales Rule (TSR) among other claims, and sought civil penalties and injunctive relief. Zachary D. Ludens, Jordan A. Shaw, and Lauren N. Palen from Shaw Lewenz’s Commercial Litigation Practice Group represented Heritage Hard Assets, LLC and moved to dismiss the 330-paragraph complaint, arguing that it was deficient and failed to comply with the pleading requirements in the Federal Rules of Civil Procedure. In granting the Motion to Dismiss, the Oklahoma Federal Court Judge agreed with Shaw Lewenz’s arguments and found that the Plaintiff’s complaint was, on its face, legally deficient and failed to state a claim.
